The Nixon Review was established to complement the ongoing efforts of the Department of Home Affairs in addressing the exploitation of migrant workers and enhancing the prevention, deterrence, and punishment of abuses within Australia's visa system. Ms. Nixon AO, APM led the review in collaboration with various Commonwealth, state, and territory agencies, as well as relevant organizations. In her assessment, Ms. Nixon considered the following sources of information:
1. Findings from prior and ongoing reviews and in
quiries, including those conducted by parliamentary bodies.
2. Regulatory strategies employed in comparable international jurisdictions. The scope of the review encompassed several key aspects:
1. Examination of specific instances highlighted in media reports, addressing their unique circumstances.
2. Assessment of how information is utilized, stored, treated, and shared within the Department of Home Affairs concerning investigations, regulations, and enforcement activities related to threat actors exploiting vulnerabilities in the visa system.
3. Evaluation of the authority, resources, and penalties at the disposal of the Office of the Migration Agents Registration Authority (OMARA) and the Australian Border Force (ABF) in investigating and taking actions against third parties, including registered and unregistered migration agents, involved in visa system exploitation.
4. Analysis of the powers and provisions for assessing the character of individuals throughout the visa process, identifying gaps and areas of vulnerability that allow threat actors to enter Australia and exploit the system.
5. Exploration of potential enhancements to visa settings to reduce the susceptibility of visa holders, maintain visa program integrity, and discourage unethical actors.
6. Examination of the processes for triage, referral, and decision-making in cases of concern, particularly when there are indications of facilitating migrant exploitation within Australia.
